If the period for which the person concerned is authorised to stay as an intra-corporate transferee in the context of long-term mobility expires while the application is being examined, he or she is issued with a document that provisionally covers his or her stay until a decision is taken on that application or until the maximum duration of his or her stay as an intra-corporate transferee referred to in Article 61/38, § 1, has expired.

The King lays down the conditions and arrangements for issuing the residence document referred to in the first subparagraph.

Art. 61/48(1)#

1° if he or she proves that he or she holds a travel document, or a residence document in lieu thereof, that meets the validity conditions laid down in Article 6(1)(a) of the Schengen Borders Code;

2° if he or she proves that he or she has sickness insurance covering all risks in Belgium for himself or herself and his or her family members;

3° if he or she proves that he or she holds an ICT permit issued by the first Member State;

4° if he or she proves that he or she has sufficient resources for the duration of the intended stay to provide for his or her own needs and those of his or her family members, so as not to become a burden on the public authorities, taking into account in particular the income that he or she will receive during his or her stay as an intra-corporate transferee;

5° except in the case of a renewal of the application for an authorisation to stay as an intra-corporate transferee in the context of long-term mobility, if he or she produces an extract from the criminal record or an equivalent document, together with a legalised translation where applicable, issued by the country of origin or by the country of his or her last residence, less than six months old and attesting that he or she has not been convicted of ordinary-law crimes or offences.

Where it is duly shown to be impossible to produce the document referred to in § 1, 5°, the Minister or the Minister’s delegate may nevertheless grant or renew the authorisation to stay as an intra-corporate transferee, taking account of the circumstances.
