Art. 61/13/5(2)#

The following documents are produced with the notification:

1° a copy of his or her valid passport or a travel document in lieu thereof meeting the conditions laid down in Article 6(1)(a) of the Schengen Borders Code, covering at least the duration of the planned stay;

4° evidence that, during the planned stay, he or she will have sufficient means of subsistence to cover his or her travel costs to the first Member State in the cases referred to in Article 61/13/7 and not to become a burden on the social assistance system of the Kingdom during his or her stay. Account is taken in particular of the income that he or she will receive during his or her stay as a researcher;

5° if he or she is over eighteen years of age, an extract from the criminal record or an equivalent document, together with, where applicable, its legalised translation, issued by the country of origin or by the country of his or her last residence, less than six months old, and certifying that he or she has not been convicted of ordinary-law crimes or offences;

6° a valid researcher’s permit issued by the first Member State covering at least the period of short-term mobility.

Where it is duly justified that the document referred to in the first subparagraph, 5°, cannot be produced, the Minister or the Minister’s delegate may nevertheless, taking account of the circumstances, grant authorisation to stay as a researcher within the framework of short-term mobility.

If they are drawn up in a language other than one of the three national languages or English, the documents produced must be accompanied by a sworn translation into one of the three national languages or into English.

7° in the notification for short-term mobility, use was made of false or misleading information or false or falsified documents, or of fraud or other unlawful means, which contributed to obtaining the authorisation for short-term mobility.

Where the Minister or the Minister’s delegate raises an objection in accordance with this Article, the mobility may not begin.

If the short-term mobility has already begun, it ends immediately.

If short-term mobility is refused to the researcher, short-term mobility is automatically also refused to the family member.

The objection is addressed to the competent authorities of the first Member State, to the approved research organisation in Belgium that made the notification, and to the researcher and, where applicable, to the family member personally.

Where the notification is subsequently supplemented with the date on which a family member will join the researcher, the Minister or the Minister’s delegate has thirty days from receipt of the complete notification to raise an objection.
