e) the unmarried disabled child over eighteen years of age of the sponsor, of his or her spouse or of the registered partner referred to in b), provided that he or she produces a certificate from a doctor approved by the Belgian diplomatic or consular post stating that, owing to his or her disability, he or she is unable to provide for his or her own needs.
The registered partners referred to in the first subparagraph, 4°, 5°, b), and 6°, b), must meet the following conditions:
1° prove that they have a duly established durable and stable partner relationship. The durable and stable nature of that relationship is established:
a) if the partners prove that they have cohabited lawfully and without interruption in Belgium or in another country for at least one year before the application;
b) or if the partners prove that they have known each other for at least two years before the application and provide evidence that they have maintained regular contact by telephone, by ordinary post or by e-mail, that they have met three times during the two years preceding the application and that those meetings total 45 days or more;

In so far as the family ties already existed before the sponsor’s arrival in the Kingdom, the Minister or the Minister’s delegate takes into account the age that the family member referred to in the first subparagraph, 5°, c) and d), or the sponsor referred to in the first subparagraph, 5°, f), had at the time when the application for international protection or the application for admission to stay on grounds of statelessness referred to in Article 57/38 was lodged. In assessing that three-month period, the Minister or the Minister’s delegate takes into account particular circumstances that make the late submission of the application objectively excusable.
The provisions relating to children apply unless an international agreement binding on Belgium provides for more favourable provisions.

The foreign nationals referred to in paragraph 1, first subparagraph, 2° and 3°, must provide evidence that they have stable, sufficient and regular means of subsistence to provide for their own needs and not to become a burden on the public authorities.
The family members referred to in paragraph 1, first subparagraph, 5°, a) to e), and 6°, a) to e), must provide evidence that the sponsor has sickness insurance covering risks in Belgium for himself or herself and the members of his or her family, as well as sufficient accommodation that is regarded as normal for a family of comparable size and that meets the legal safety and health standards in force. The King determines, by decree deliberated in the Council of Ministers, the criteria that the property must meet and the manner in which the foreign national proves that the property meets the conditions laid down.
The family members referred to in paragraph 1, first subparagraph, 5°, a) to e), and 6°, a) to e), must also provide evidence that the sponsor has stable, regular and sufficient means of subsistence as provided for in paragraph 5 to provide for his or her own needs and those of the members of his or her family and to prevent them from becoming a burden on the public authorities. This condition does not apply if the foreign national is joined only by the members of his or her family referred to in paragraph 1, first subparagraph, 5°, c) to e), or 6°, c) to e).
The second and third subparagraphs do not apply to the family members referred to in paragraph 1, first subparagraph, 5°, in so far as the application for residence on the basis of this Article has been lodged within six months of the decision granting refugee status or the decision granting admission to stay in accordance with Article 57/45 and the foreign national produces some initial evidence of his or her identity and of the relationship by blood or by marriage when the application is lodged, and provided that he or she has completed the application with all the documents referred to in Article 12bis, §§ 2 to 4, no later than ten months after the decision granting refugee status or the decision granting admission to stay in accordance with Article 57/45. In assessing those time limits, the Minister or the Minister’s delegate takes into account particular circumstances that make the late submission of the application objectively excusable. The King determines, by decree deliberated in the Council of Ministers, the arrangements for lodging the application and the manner in which the family member may prove that he or she meets the preceding conditions.
By way of derogation from the fourth subparagraph, the Minister or the Minister’s delegate may, however, by a reasoned decision, require the production of the documents referred to in the second and third subparagraphs where family reunification is possible in another country with which the sponsor or his or her family member has a special link, taking into account the factual circumstances, the conditions for family reunification laid down in that other country and the extent to which the foreign nationals concerned are able to meet them.
All the family members referred to in paragraph 1 must also provide evidence that they do not suffer from any of the diseases that may endanger public health listed in the annex to this Law.

The Minister or the Minister’s delegate may decide, in any of the following cases, that a foreign national who has been admitted to stay in the Kingdom for a limited period as a beneficiary of international protection status under Article 49, § 1, second subparagraph, or Article 49/2, § 2, no longer has the right to stay in the Kingdom, and may issue him or her with an order to leave the territory:
1° where the international protection status has been withdrawn by the Commissioner General for Refugees and Stateless Persons in accordance with Article 14(1)(a) or Article 19(1)(a) of Regulation (EU) 2024/1347 of the European Parliament and of the Council. The Minister or the Minister’s delegate takes into account the degree to which the foreign national is rooted in society;
2° where the international protection status has been withdrawn by the Commissioner General for Refugees and Stateless Persons in accordance with Article 14(1)(d) and (e) or Article 19(1)(b) of Regulation (EU) 2024/1347.
The Minister or the Minister’s delegate may at any time decide to withdraw the stay of a foreign national who has been admitted to stay in the Kingdom for a limited or unlimited period as a beneficiary of international protection status under Article 49, § 1, second or third subparagraph, or Article 49/2, § 2 or § 3, or to end that stay, and to issue him or her with an order to leave the territory, where the international protection status has been withdrawn by the Commissioner General for Refugees and Stateless Persons in accordance with Article 14(1)(b) or (c) and Article 19(1)(b) or (c) of Regulation (EU) 2024/1347 or where the foreign national has renounced his or her international protection status.
Where the Minister or the Minister’s delegate intends to take a decision referred to in the first and second subparagraphs, he or she takes into consideration the nature and solidity of the family relationships of the person concerned, the duration of his or her stay in the Kingdom and the existence of family, cultural or social ties with his or her country of origin.
Without prejudice to the application of paragraph 2, the Minister or the Minister’s delegate may also end the right of residence of the family members referred to in Article 10, § 1, first subparagraph, 4° to 6°, if the right of residence of the sponsor has been ended or has been withdrawn on the basis of the first or second subparagraph.

Article 12Registration in the register of foreign nationals
Amended by: Law of 6 August 1993; Law of 24 May 1994; Law of 15 September 2006; Law of 6 May 2009
A foreign national admitted or authorised to stay in the Kingdom for more than three months is entered in the register of foreign nationals by the municipal administration of his or her place of residence. Solely for the purposes of the Law of 19 July 1991 on population registers, identity cards, foreigners’ cards and residence documents and amending the Law of 8 August 1983 organising a National Register of Natural Persons, the register of foreign nationals is considered to form an integral part of the population registers.
By way of derogation from the first subparagraph, a foreign national who submits an asylum application is entered in the waiting register referred to in Article 1, § 1, first subparagraph, 2°, of the aforementioned Law of 19 July 1991.
The King determines the method of registration and the model of the residence document issued on registration and serving as proof of it.
The application for registration must be submitted by the foreign national within eight working days of his or her entry into the Kingdom if he or she obtained the authorisation to stay, or was recognised as having the right to stay, abroad. It must be submitted within eight working days of receipt of that authorisation or admission if it was obtained or recognised in the Kingdom.
The King may, by decree deliberated in the Council of Ministers and by way of a general provision, set a shorter time limit in exceptional circumstances.
(Subparagraph repealed)

1° s'il est déjà admis ou autorisé à séjourner plus de trois mois dans le Royaume à un autre titre et présente toutes les preuves visées au § 2 avant la fin de cette admission ou autorisation;
2° s'il est autorisé au séjour pour trois mois au maximum et, si la loi le requiert, qu'il dispose d'un visa valable en vue de conclure un mariage ou un partenariat en Belgique, si ce mariage ou partenariat a effectivement été conclu avant la fin de cette autorisation et s'il présente toutes les preuves visées au § 2 avant la fin de cette autorisation;
3° s'il se trouve dans des circonstances exceptionnelles qui l'empêchent de retourner dans son pays pour demander le visa requis en vertu de l'article 2 auprès du représentant diplomatique ou consulaire belge compétent, et présente toutes les preuves visées au § 2 ainsi qu'une preuve de son identité;
4° s'il est un membre de la famille visé à l'article 10, § 1er, alinéa 1er, 5°, c) à f), ou 6°, c) à e), et est autorisé au séjour pour trois mois au maximum, ou s'il est un membre de la famille visé à l'article 10, § 1er, alinéa 1er, 4°, ou s'il est un membre de la famille visé à l'article 10, § 1er, alinéa 1er, 5°, d'un étranger admis à séjourner dans le Royaume conformément à l'article 57/45 et qui est présent sur le territoire du Royaume en raison de la demande d'admission au séjour pour apatridie mais qui, individuellement, ne remplit pas les conditions nécessaires pour obtenir cette protection, et pour autant que le lien familial existait déjà avant l'arrivée de l'étranger accompagné dans le Royaume;
5° (…)
Where the foreign national referred to in § 1 submits his or her application to the Belgian diplomatic or consular representative competent for his or her place of residence or stay abroad, the application must be accompanied by the documents proving that he or she fulfils the conditions referred to in Article 10, §§ 1 to 3, including in particular a medical certificate showing that he or she does not suffer from any of the diseases listed in the annex to this Law and an extract from the criminal record or an equivalent document, if he or she is over eighteen years of age.
The date of filing of the application is the date on which all those documents, complying with Article 30 of the Law of 16 July 2004 establishing the Code of Private International Law or with the international conventions on the same matter, are produced.
The decision on admission to stay is taken and notified as soon as possible and at the latest within nine months of the date of filing of the application as defined in the second subparagraph. The decision is taken in the light of all the elements in the file.
If the condition relating to the sufficiency of resources referred to in Article 10, § 5, is not met, the Minister or the Minister’s delegate must determine, according to the specific needs of the foreign national being joined (the sponsor) and of the members of his or her family, the means of subsistence required to meet their needs without becoming a burden on the public authorities. To that end, the foreign national provides, when submitting the application, all the documents and information relevant for determining that amount. In the assessment, the Minister or the Minister’s delegate takes into account all valid evidence produced for that purpose by the foreign national. The King may determine which documents may, where applicable, be produced for the assessment of needs.
In exceptional cases linked to the complexity of the examination of the application, and in the context of an investigation concerning a marriage referred to in Article 146bis of the Civil Code or the conditions of the partnership referred to in Article 10, § 1, second subparagraph, the Minister or the Minister’s delegate may extend that time limit twice, by three months each time, by a reasoned decision brought to the applicant’s attention.
If no decision has been taken on expiry of the nine-month time limit following the date of filing of the application, as extended where applicable in accordance with the fifth subparagraph, admission to stay must be recognised.

In the cases referred to in § 1, second subparagraph, 1° and 2°, where the foreign national referred to in § 1 reports to the municipal administration of his or her place of residence and declares that he or she is in one of the cases provided for in Article 10, he or she is, on the basis of the documents required for his or her entry and stay and provided that all the evidence referred to in § 2, first subparagraph, is produced, issued with a certificate of receipt of the application. The municipal administration informs the Minister or the Minister’s delegate of the application and forwards a copy of it to him or her without delay.
Where the Minister or the Minister’s delegate declares the application admissible, or where no decision has been brought to the attention of the mayor (bourgmestre) or the mayor’s delegate within five months of the issue of the certificate of receipt referred to in the first subparagraph, the foreign national is entered in the register of foreign nationals and issued with a document certifying that he or she is so registered.
In the event of a favourable decision of the Minister or the Minister’s delegate on admission to stay or if, within nine months of the issue of the certificate of receipt referred to in the first subparagraph, no decision has been brought to the attention of the municipal administration, the foreign national is admitted to stay.
In exceptional cases linked to the complexity of the examination of the application, and in the context of an investigation concerning a marriage referred to in Article 146bis of the Civil Code or the conditions of the partnership referred to in Article 10, § 1, second subparagraph, and by a reasoned decision brought to the applicant’s attention before the expiry of the time limit laid down in the third subparagraph, the Minister or the Minister’s delegate may extend that time limit twice (…), by three months each time.
§ 3bis. By way of derogation from § 2, third, fifth and sixth subparagraphs, and from § 3, third and fourth subparagraphs, the decision on admission to stay of the family members referred to in Article 10, § 1, first subparagraph, 6°, a) to e), of a foreign national who is a long-term resident and a former holder of an EU Blue Card is taken and notified as soon as possible and at the latest within four months of the date of filing of the application as defined in § 2, second subparagraph.
In exceptional cases linked to the complexity of the examination of the application, and in the context of an investigation concerning a marriage referred to in Article 146bis of the Civil Code or the conditions of the partnership referred to in Article 10, § 1, second subparagraph, the Minister or the Minister’s delegate may, by a reasoned decision brought to the applicant’s attention, extend that time limit once, by three months.
If, on expiry of the four-month time limit following the date of filing of the application, as extended where applicable in accordance with the second subparagraph, no decision has been taken, admission to stay must be recognised where the required documents have been produced. Otherwise, admission to stay is refused.

In the cases referred to in § 1, second subparagraph, 3° and 4°, where the foreign national referred to in § 1 reports to the municipal administration of his or her place of residence and declares that he or she is in one of the cases provided for in Article 10, the municipal administration checks without delay with the Minister or the Minister’s delegate whether the application is admissible. Where the Minister or the Minister’s delegate considers that the foreign national fulfils the conditions of § 1, second subparagraph, 3° and 4°, he or she so informs the municipal administration, which enters the foreign national in the register of foreign nationals and issues him or her with a document certifying that the application has been submitted and with a document certifying that he or she is entered in the register of foreign nationals.
Any medical situation relied on by the foreign national is assessed by a medical officer or a doctor designated by the Minister or the Minister’s delegate, who gives an opinion on it and may, if necessary, examine the foreign national and request the additional opinion of experts designated in accordance with Article 9ter, § 5.
The provisions of § 3, third and fourth subparagraphs, and of § 3bis also apply.

Article 13Limited-duration stays, renewal and orders to leave
Amended by: Law of 8 July 2011; Law of 15 May 2012; Law of 4 May 2016; Law of 31 July 2020; Law of 11 July 2021; Law of 10 March 2024; Law of 18 July 2025; Law of 16 June 2026
Unless expressly provided otherwise, the authorisation to stay is granted for a limited period, set either by this Law, or on account of special circumstances specific to the person concerned, or in relation to the nature or duration of the work that he or she is to perform in Belgium.
An authorisation to stay granted for a limited period on the basis of Article 9ter becomes unlimited on expiry of the period of five years following the application for authorisation.
Admission to stay under Article 10 is recognised for a limited period during the period of five years following the issue of the residence document or, in the cases referred to in Article 12bis, §§ 3, 3bis or 4, following the issue of the document certifying that the application has been submitted, on expiry of which it becomes unlimited, in so far as the foreign national still meets the conditions of Article 10. Otherwise, the Minister or the Minister’s delegate refuses the stay of unlimited duration and grants a new stay for a limited period, the renewal of which is subject to possession of sufficient resources so as not to become a burden on the public authorities and of sickness insurance covering all risks, and in so far as the foreign national does not constitute a danger to public policy and/or national security.
By way of derogation from the third subparagraph, the family members referred to in Article 10, § 1, first subparagraph, 5°, f), must, in order to be granted a stay of unlimited duration, also prove that they have stable, sufficient and regular means of subsistence as provided for in Article 10, § 5.
By way of derogation from the third subparagraph, the family members of a foreign national authorised to stay for a limited period, to whom Article 10, § 1, first subparagraph, 1°, applies, obtain a residence document with the same period of validity as the residence document of the sponsor.
By way of derogation from the third subparagraph and subject to Article 23(3) to (5) of Regulation (EU) 2024/1347, the family members referred to in Article 10, § 1, first subparagraph, 4°, receive a residence document whose period of validity expires on the same date as that of the residence document of the foreign national whom they accompany. That residence document may be renewed in so far as the residence document issued to the foreign national admitted to stay in the Kingdom as a beneficiary of international protection status is renewed and on condition that the family member still meets the conditions laid down in Article 23 of Regulation (EU) 2024/1347. The admission to stay becomes of unlimited duration when the accompanied foreign national holds a residence document of unlimited duration and in so far as the family member still meets the conditions laid down in Article 23 of Regulation (EU) 2024/1347.
(…) The King sets the period of validity of the residence document issued to a foreign national authorised or admitted to stay for an unlimited period.
The family members referred to in Article 10bis, §§ 1 to 6, obtain a residence document whose expiry date is the same as that of the residence document of the sponsor.
Note. In the fourth subparagraph, the French text reads “doivent, pour l’octroi d’un séjour d’une durée illimitée,-8 doivent également prouver”: the verb “doivent” is repeated and the characters “-8” are stray. The translation reads the sentence without them.
