In short

  • An incoming employee qualifies if recruited from abroad with specific expertise that is scarce in the Netherlands, and if he or she lived more than 150 kilometres from the Dutch border for more than two thirds of the 24 months before starting (Art. 10e).
  • Specific expertise is assumed above a salary standard of €48,013 a year, or €36,497 for holders of a master’s degree under 30, both indexed each year; researchers and medical specialists in training qualify regardless of salary (Art. 10eb).
  • The ruling lasts at most five years (Art. 10ec). Earlier work or stays in the Netherlands in the past 25 years shorten it (Art. 10ef).
  • The employer and the employee apply jointly to the inspector. If the request is made within four months of the start, the decision applies from the first day; otherwise from the following month (Art. 10ei).
  • The consolidated Decree still contains a 30%, 20% and 10% phase-out in Art. 10ea, which the Act itself no longer provides for. See the status note under that Article.

Who it affects

  • Employers recruiting staff from abroad, and their payroll providers.
  • Incoming employees and PhD holders starting work in the Netherlands.
  • Employers sending staff abroad (outgoing employees).

BCA commentary

Three tests

The ruling turns on three questions. Was the employee recruited from abroad and did he or she live more than 150 kilometres from the Dutch border for more than two thirds of the preceding 24 months (Art. 10e)? Does the employee have specific expertise that is scarce in the Netherlands, which the Decree assumes above the salary standard (Art. 10eb)? And is the ruling still within its five-year maximum, reduced by earlier periods in the Netherlands (Art. 10ec, Art. 10ef)?

Ask in time

The ruling is granted by the inspector at the joint request of employer and employee. A request filed within four months of the start of employment has effect from day one (Art. 10ei). After a change of employer the ruling can continue for the remaining period if the new employment contract is concluded within three months (Art. 10ed).

A text out of step

Article 10ea of the consolidated Decree still sets 30% for 20 months, then 20% and 10%. The Act was amended from 1 January 2025 to remove that phase-out and from 1 January 2027 to replace 30% by 27% (Stb. 2024, 434). We translate the Decree as officially consolidated and flag the difference in a note under Art. 10ea.

A request for the application or continued application of the evidentiary rule in respect of an incoming employee is made to the inspector. The inspector decides on the request by a decision open to objection.

Art. 10ei(2)#

If the request is made within four months of the start of the period of employment as an extraterritorial employee by the withholding agent, the decision has retroactive effect up to and including the start of the period of employment as an extraterritorial employee. If the request is made later, the decision applies from the first day of the month following the month in which the request was made.

Art. 10ei(3)#

The inspector may, of its own motion or on request, revise the decision in favour of the employees or the withholding agent in the event of inaccuracies at the time that decision was issued.

Art. 10ei(4)#

The inspector may withdraw or revise the decision to the detriment of the employee or the withholding agent in the event of inaccuracies at the time that decision was issued. A withdrawal or revision has consequences only for a future wage period.

Art. 10ei(5)#

By way of derogation from paragraph 4, a withdrawal or revision may also have consequences for preceding and current wage periods if:

a. the inspector makes it plausible that the withholding agent or the employee acted in bad faith with regard to the fact that led to an inaccuracy in the decision;

b. the inspector makes it plausible that the decision was issued incorrectly as a result of an error by the inspector and that error is reasonably apparent to the employee or the withholding agent.

a. de inspecteur aannemelijk maakt dat de inhoudingsplichtige of de werknemer te kwader trouw is ter zake van het feit dat heeft geleid tot een onjuistheid in de beschikking;

Art. 10ei(6)#

A withdrawal or revision to the detriment of the employee or the withholding agent is effected by a decision open to objection. Legal remedies against this decision may relate only to the withdrawal or revision.

Art. 10ei(7)#

A withdrawal or revision to the detriment of the employee or the withholding agent is possible in so far as the decision covers a wage period in respect of which the power to impose an additional assessment referred to in Article 20 of the General State Taxes Act (Algemene wet inzake rijksbelastingen) has not lapsed.

Article 10ejSuccessive withholding agents within one group

Current wording: Stb. 2010, 885, in force 1 January 2011

Art. 10ej#

For the purposes of the provisions of this Chapter, the withholding agent is, in respect of an incoming employee, deemed to be the same withholding agent as the employee’s withholding agents that preceded it without interruption, provided that:

a. the withholding agent and the withholding agent that preceded it without interruption belong to the same related group of withholding agents within the meaning of Article 27e of the Act, and

b. it is plausible that the employee would again be regarded as an incoming employee if Article 10ed were applied.
