BCA commentary
Where the salary thresholds are
The Aliens Decree 2000 grants the highly skilled migrant permit (Art. 3.30a). This Decree sets the salary that makes the work exempt from the employment permit requirement, and that salary is in practice the test for the whole route (Art. 2.1). The amounts change every 1 January. The consolidated text translated here shows the 2026 amounts.
What counts as salary
The threshold is met by the agreed fixed gross wage, in money, per month, excluding holiday allowance. Bonuses and benefits in kind do not count. The wage must be paid at least monthly into a bank account in the employee’s name (Art. 2.1).
