In short
- Every permit for work or business is granted subject to one of the restrictions listed in Art. 3.4: work as a self-employed person, as a highly skilled migrant, as holder of an EU Blue Card, intra-corporate transfer, paid employment, research and others.
- A highly skilled migrant must work for an employer recognised as a sponsor, at a wage in line with the market (Art. 3.30a). The salary thresholds, in 2026 €5,942 a month from age 30, €4,357 under 30 and €3,122 after a Dutch degree or search year, are in Art. 2.1 of the 2022 Decree.
- The EU Blue Card needs a contract or binding job offer for highly qualified employment of at least six months and higher professional qualifications (Art. 3.30b); the salary floor is €5,942, or €4,754 for recent graduates (Art. 2.2).
- An intra-corporate transferee moves within a group as a manager, specialist or trainee employee for at most three years, or one year for trainees (Art. 3.30d, Art. 3.58).
- A self-employed person needs an essential Dutch interest, assessed under a points system, and sufficient lasting income from the business. An innovative start-up gets one year to meet those conditions (Art. 3.30).
- Graduates of Dutch universities and of designated foreign top universities, and researchers, can get a one-year search permit to look for work or set up a business (Art. 3.42).
- A highly skilled migrant permit runs for the length of the contract, up to five years, and an EU Blue Card for the contract plus three months, up to five years (Art. 3.58).

BCA commentary
Highly skilled migrant or EU Blue Card?
Both are for qualified employees, and both need a sponsor. The highly skilled migrant (kennismigrant) route turns on salary and on the employer’s recognition as a sponsor; there is no diploma test (Art. 3.30a, Art. 2.1). The EU Blue Card asks for higher professional qualifications and a contract of at least six months (Art. 3.30b). The employer does not have to be a recognised sponsor, and the card brings EU mobility rights. In 2026 the highly skilled migrant thresholds are €5,942 a month from age 30 and €4,357 under 30; the Blue Card floor is €5,942, or €4,754 for recent graduates (Art. 2.2). All amounts exclude holiday allowance and are indexed each January.
Transfers within a group
An employee of a non-EU company transferred to its Dutch entity as manager, specialist or trainee employee must use the intra-corporate transfer permit if he or she falls within Directive 2014/66/EU (Art. 3.30d). The highly skilled migrant application is then rejected (Art. 3.30a, Art. 3.30a).
Self-employed, start-ups and DAFT
The self-employed permit asks for an essential Dutch interest, judged under a points system in the Aliens Regulations 2000, and sufficient lasting income from the business (Art. 3.30). An innovative start-up working with a facilitator can get one year to grow into those conditions (Art. 3.30). US entrepreneurs often use the Dutch-American Friendship Treaty (DAFT). DAFT is not a separate article: it is the same self-employed restriction, with the essential-interest test replaced by the treaty conditions set out in the Aliens Circular 2000.
If the job ends
An EU Blue Card holder who becomes unemployed has three months to find a new job, or six months after two years (Art. 3.89b). If an employer loses its recognition as a sponsor, a highly skilled migrant acting in good faith gets three months to find a new recognised employer before the permit can be withdrawn (Art. 3.91a).

The application may not be rejected on the ground that the employer has not been recognised as a sponsor under Article 2c of the Act or has not made a declaration as referred to in Article 2a(2) of the Act for the residence of the foreign national, if the foreign national has Turkish nationality. In dat geval wordt de werkgever niet als referent aangewezen.
The application must be rejected if the foreign national qualifies for the regular residence permit for a fixed period subject to the restriction “intra-corporate transfer”, in which case the latter residence permit is granted ex officio, without prejudice to Article 24a(3) of the Act.

The EU Blue Card is granted to a foreign national as referred to in Article 2.2 of the Foreign Nationals Employment (Implementation) Decree 2022 who:
a. has a valid employment contract or a binding job offer for highly qualified employment within the meaning of Article 2, point (2), of Directive (EU) 2021/1883 for a period of at least six months with an employer in the Netherlands, under which a gross income is earned that is at least equal to the wages referred to in Article 2.2 of the Foreign Nationals Employment (Implementation) Decree 2022;
b. performs or will perform work in the Netherlands for an employer on whom, in the period of no more than five years immediately preceding the application, no sanction has been imposed for an offence under the Foreign Nationals Employment Act (Wet arbeid vreemdelingen), the Placement of Personnel by Intermediaries Act (Wet allocatie arbeid door intermediairs), the Working Hours Act (Arbeidstijdenwet), the Working Conditions Act (Arbeidsomstandighedenwet) or the Minimum Wage and Minimum Holiday Allowance Act, or for failure to pay, or to pay in full, wage tax, employee insurance contributions or national insurance contributions;
c. will perform work in the Netherlands that meets the conditions set out in applicable law, collective agreements or practices in the relevant occupational branches for highly qualified employment;

i. does not pose a threat to public policy as referred to in Articles 3.77 and 3.78 or to national security.
Note. In point (e) the Dutch text literally reads “or that carries out no economic activity”: the negation of the first limb has not been carried over to the second. Article 7(2)(c) of Directive (EU) 2021/1883 permits refusal where the employer’s business is being, or has been, wound up under national insolvency laws or carries out no economic activity, so the intended meaning is that the undertaking must not be in insolvency and must carry out economic activity.
Note. In point (b) the Dutch text names the “Wet allocatie arbeid door intermediairs”; the official title of that Act is Wet allocatie arbeidskrachten door intermediairs.
