In exceptional cases, a third-country national staying lawfully in the territory for a period of up to three months may be authorised to submit to the Minister, within that period, an application for an authorisation of stay for a period of more than three months, if he or she provides evidence that he or she meets all the conditions required for the category of authorisation sought and if returning to his or her country of origin would constitute an unjust burden for him or her.

Article 40Declaration of arrival and issue of the residence permit
Amended by: Law of 19 June 2013; Law of 1 August 2018; Law of 20 July 2018; Law of 4 December 2019; Law of 16 June 2021
Without prejudice to the existing rules on population registers, a third-country national authorised to stay in the territory for a period of more than three months must, within three working days of the date of his or her entry into the territory, report with the authorisation of stay to the municipal administration of the place where he or she intends to take up residence in order to make a declaration of arrival. A copy of the declaration is issued to the person concerned as a receipt. Possession of the receipt and of the authorisation of stay proves the lawfulness of his or her stay until the residence permit is issued.
A third-country national covered by Article 38, point 3, other than under Article 67-1, must report to the Minister in order to obtain the certificate provided for in Article 58(7), Article 67(7) or Article 67-2(4). That document certifies his or her right to stay in the Grand Duchy of Luxembourg for the duration of the mobility and enables him or her to register with the municipal administration of his or her place of residence for a stay of more than three months.
The long-stay visa provided for in Article 38, point 4, enables the third-country national to register with the municipal administration of his or her place of residence for a stay of more than three months.
Before a period of three months has expired, the third-country national must apply for the issue of his or her residence permit by presenting to the Minister the receipt for the declaration of arrival issued by the municipal authority, the medical certificate referred to in Article 41(3) and, where applicable, proof of appropriate accommodation, if this is required. When the application for the issue of the residence permit is made, an issuing fee is charged, the amount of which, calculated on the basis of the administrative cost, is set by Grand-Ducal regulation.
If he or she meets all the conditions laid down in paragraphs 1 and 2 above, the Minister issues to him or her the residence permit, which indicates the type of authorisation he or she holds and is drawn up in the form laid down by Grand-Ducal regulation. The particulars of the authorisation to work issued under Article 42 appear on the residence permit, whatever the category of the permit.
The municipal authority is informed of the issue of the permit.
Without prejudice to the provisions of Article 80(4), a foreign national who intends to leave the Grand Duchy of Luxembourg for a period of more than six months must surrender his or her residence permit to the Minister and make a declaration of departure to the local authority of the municipality where he or she has stayed.
Where a third-country national who proves that he or she has been the victim of a forced marriage and has been compelled to leave Luxembourg territory has lost his or her residence permit, he or she benefits from a simplified procedure for recovering it, the conditions of which are laid down by Grand-Ducal regulation.
Article 41Medical examination and medical certificate
The third-country national must undergo a medical examination before applying for the issue of the residence permit. The examination is carried out by a doctor established in Luxembourg and authorised to practise there as a general practitioner, a specialist in internal medicine or a specialist in paediatrics. The arrangements for and the content of the medical examination are laid down by Grand-Ducal regulation.
The medical examination referred to in paragraph 1 above is not systematic for a third-country national who is a long-term resident in another Member State, or for a member of his or her family.
On completion of the examination, a certificate is issued stating whether or not the third-country national meets the medical conditions permitting his or her stay in the territory. Every certificate must be sent to the delegated doctor referred to in Article 28(3), who checks that it complies with the provisions of this Article and those adopted for its implementation. After that check, the certificate is attached to the application for the issue of the residence permit referred to in Article 40(2). The residence permit is refused to any person who refuses to undergo the prescribed medical check.
Where the result of the medical examination shows that the third-country national suffers from a condition requiring treatment, a specific certificate containing the conclusions of the examination is drawn up in triplicate and sent in a sealed confidential envelope marked “medical confidentiality” to the person concerned, to the delegated doctor and, at the request of the person concerned, to his or her attending doctor.
The costs of the medical check and of the issue of the medical certificate are borne by the third-country national, unless he or she is a long-term resident of another Member State or a member of such a person’s family.
A Grand-Ducal regulation determines the diseases and disabilities to be covered by the examination referred to in this Article and organises the arrangements for the examination. It lays down the arrangements for drawing up and issuing the medical certificate.
